Simple assault under California Penal Code 240 is usually a misdemeanor in California. In most cases the penalty for assault is a fine of up to $1,000 and/or up to 6 months in jail. Battery is also a misdemeanor, punishable by a fine of up to $2,000 and/or up to 6 months in jail. But if you actually inflict serious injury on a victim, you face the tougher penalties that go with “battery causing serious bodily injury,” which may be charged as a misdemeanor or as a felony.

If it is charged as a felony, battery causing serious bodily injury under California Penal Code 242 is punishable by 2 to 4 years in prison. Misdemeanor battery on a peace officer is a separate charge punishable by:

– probation for up to three years
– up to a year in jail
– a fine of up to $2,000 (and up to $10,000 if the officer suffers an injury)
– completion of a batterer’s program
– community service

California felony battery on a peace officer under California Penal Code 243(c)(2) or 243(d) is punishable by:

– probation
– 16 to 36 months in jail (or 2 to 4 years if “serious bodily injury” is inflicted)
– a maximum $10,000 fine
– a “strike” on your record under the California Three Strikes Law
