PENALTIES

Petty theft in California under California Penal Codes 484 and 488 is a misdemeanor, and most petty theft charges in this state are related to shoplifting incidents. The maximum penalties for most petty theft convictions are a fine of up to $1,000, up to 6 months in jail, or both. Although petty theft is a misdemeanor, a second offense can be charged as a felony under Penal Code 666 (“Petty Theft with a Prior”). A grand theft charge in California under California Penal Code 487 may be either a felony or a misdemeanor. For felony grand theft, you may be sentenced to jail for 16 to 36 months. The maximum jail term for misdemeanor grand theft is a year.
