CALIFORNIA PENAL CODES 484, 487, 488, and 666

The crime of theft in California is the unlawful taking of someone else’s property. When the stolen property taken is valued at more than $950, is a motor vehicle or a firearm, or is stolen directly in a mugging or an armed robbery, then the crime is “grand” theft. When the stolen property has a value under $950, is not a motor vehicle or a firearm, and it isn’t stolen directly in a mugging or armed robbery, then the crime is usually charged as petty theft. If you are charged with petty or grand theft or another theft-related crime in southern California, get legal help at once and call experienced lawyer, Simon Budhwani, Esq. Our Orange County theft lawyers have considerable experience representing clients charged with petty theft, grand theft, and related crimes.

PENALTIES

Grand theft in California may be charged as a misdemeanor or as a felony under California Penal Code 487. The maximum sentence for misdemeanor grand theft is a year in jail. For felony grand theft, you may be incarcerated for 16 to 36 months. Petty theft is a misdemeanor in California under California Penal Codes 484 and 488, and most petty theft charges stem from shoplifting incidents. The maximum penalties for most petty theft convictions are a fine of up to $1,000, up to 6 months in jail, or both. While petty theft is a misdemeanor as a first offense, a second offense may be charged as a felony under California Penal Code 666 (“Petty Theft with a Prior”).
